Dick Bufkin

Top Forensic Accountant in Dallas

After his undergraduate work in accounting, Dick Bufkin began his career with Peat, Marwick, Mitchell & Co., which was then the largest of the “Big 8” public accounting firms.  He continued with the firm for three years until he began law school.  He continued to practice accounting throughout law school when he was also an accounting instructor in the Texas Tech University School of Business.  After law school, he began law practice in Dallas, which he has continued since 1976.

Mr. Bufkin’s early law practice concentrated in the areas of tax law and business related transactions.  While practicing law, he obtained a second law degree, an LLM (taxation) from SMU, attending those law classes primarily in the evenings.  During the last 20 years, his primary practice areas have been financially oriented trial work in business, bankruptcy adversary and divorce cases.

The  creative and “outside the box” formulation and presentation of lost profits and other financial information have become a high priority in Mr. Bufkin’s trial work.  More and more frequently, Mr. Bufkin has been called upon to be a consulting expert and testifying witness, providing these skills to other lawyers and their clients.

Enhancing his presence in business cases, Dick Bufkin has has recently received his Certification in Financial Forensics (CFF) from the AICPA.  He has also completed numerous hours of formal professional education courses directly focused on forensic accounting and litigation service skills.

One particularly helpful training was dedicated solely to operation of the widely used Quick Books accounting software.  The training has provided the ability to (i) navigate through the books and records of opposing parties who use Quick Books, and (ii) create custom reports from those records.  Creating custom reports allows one to showcase and simplify key evidence.  This has already been invaluable in several cases.

Dick Bufkin is one of very few lawyers anywhere holding the CFF credential from the AICPA.

Mr. Bufkin has long provided professional services which have reflected a combination of legal, financial,
tax and related advice. Since 2010, he has added a focus of providing forensic accounting and related expert
witness services.

PROFESSIONAL EXPERIENCE

Mr. Bufkin was initially employed after his undergraduate work in 1970 for Peat Marwick Mitchell & Co. It was then the world’s largest public accounting firm. He worked there on a variety of audit and tax engagements. In 1973 he began law school, during which he maintained a tax and accounting practice.  During that time, he also taught accounting in the School of Business at Texas Tech University. In 1976 he
began a legal career, focused on financially oriented planning, transactions and litigation.
Since 1976, Mr. Bufkin, has provided legal representation and related financial advice in a variety of business matters. This representation includes business litigation and arbitration, as well as divorce cases in which one or more financial issues are paramount (e.g. valuation and division of closely held businesses, personal goodwill, etc.). During recent years, trial work in the bankruptcy courts as well as “business deals gone bad” litigation has predominated his docket.
His trial and financial transaction experience has spanned a broad spectrum of business and commercial practice, including: tax planning, compliance, administrative and litigation matters, corporate matters, partnership, joint venture and limited partnership matters, commercial real estate matters, insurance company, agency and reinsurance matters; oil and gas matters, acquisitions and mergers, commercial and real estate lending, real estate and personal property leasing.

EXPERT SERVICES

CONSULTING AND TESTIFYING EXPERT IN FINANCIAL MATTERS
Mr. Bufkin attained the prestigious Certification in Financial Forensics by the American Institute of Public
Accountants in 2010. Since that time, Mr. Bufkin has begun a greater focus on serving as a consulting and/or
testifying witness in financially oriented cases.
Few accountants and even fewer lawyers hold this certification. The financial forensic and similar financial work done by Mr. Bufkin, while serving as trial counsel over the years, qualified for and served as the basis of his meeting the experiential requirement in attaining the Certification in Financial Forensics from the AICPA.
The broad classes of financial forensic matters within his experience and training include the following:

Bankruptcy, insolvency, fraudulent conveyance and related matters;
Lost profits and other economic damages;
Family law financial issues; and
Financial statement errors, omissions and misrepresentations.
